Q1: If a HDB owner (5-room flat) lists his mother as occupier in order to fulfill the HDB ruling to form a nucleus and the mother passes away later on, will HDB force him to sell the flat if he is renting it out?

Q2: If he is already staying in a condo & the HDB flat already passed the 5-year MOP period, can he still hold on to the HDB flat & continue renting it out after the mother passes away? If his wife is admitted as "occupier", it also doesn't seem very right since they are all staying in condo & are renting out the HDB flat, right?

Q3: If the wife's name is entered as joint owner after the owner's mother passes away, will they have to execute a fresh S&P agreement? Let's assume that the HDB flat loan has already been fully settled & there are no more loan outstanding.

Since he is the owner he can still keep the flat unless he decides to sell it. If the condo is purchased before the flat, there is no issue. However if it is an inheritance, than I think he needs to sell the flat if he owns a condo. Stand to be corrected.

SINGAPORE: Unmarried Singaporean and Permanent Resident (PR) siblings whose parents live overseas can no longer buy a new or resale HDB flat, from Monday.

The government said they can either rent a room or a small flat from the open market.

It said with the liberalisation of the subletting market for HDB flats over the years, the Citizen-Singapore PR sibling scheme, introduced since 1990, is now no longer necessary.

Previously, the government allowed unmarried Singaporean siblings to buy a new or resale HDB flat, while PR siblings could buy a resale flat on a case-by-case basis with certain conditions attached.

Senior Minister of State for National Development & Education Grace Fu said: "As HDB has been very stringent in assessing applications for this scheme, the number of such cases is small.

"There are about 300 cases each year, or less than one per cent of total flat transactions".

I assume he is a Singaporean. If he is at least 35 years old, he should be able to keep the HDB.

300 cases per year is a lot. Very disappointed with the government policies nowadays, especially when the public is paying top dollars to these people. What to do, it has happened...

Just to clarify:
the HDB flat was bought in 2004 directly from HDB. 5-year MOP over already. It's an HDB 5-room flat. Condo bought in 2009. He is Singaporean, married & > 35 years old. Wife's name not in the flat coz it was bought before marriage & the mum's name was listed as occupier to form a nucleus under HDB ruling.

Basically at the present moment, he is not affected by any of the recent property cooling measures. However if his mother passes away, there is no more nucleus as required by HDB so will HDB force him to sell the flat? by then the flat will be tenanted out & not owner-occupied.
